Planning and Land/Property
Registry
The
local council will be the first port of call for planning applications, where
they will be the arbiters of all decisions. In effect change of use between the
registered use of a piece of land/property in their areas.
If refusal is forthcoming they applicant can appeal, via their local
representative to the full council whose opinion, on a simple majority, will be
final for the following 3 years or till after the next local election whichever
is sooner.
The local council will be responsible for keeping and maintaining the Land Registry for their area together with the building regulations .
All land/property will be recorded against a “Tax Unit” and will be assessed as to its value (Residential, Good agricultural, Poor agricultural, Forestry, Recreational etc. graded 1-12 see below)
Property Land Level (PLL)
1. Residential. See Housing no property registered as residential can be let short term without the owner being resident.
2. Housing not occupied by a residential tax unit. (can be used for short term let)
3. Short-term accommodation i.e. Hotels etc.
4. Retail
5. Light manufacture providing services direct to the public, e.g. garages, dentists, gyms.
6. Small manufacture units under 300 square metres.
7. Large manufacture units.
8. Good Agricultural
9. Poor Agricultural
10. Small Agricultural (Allotments/gardens)
11. Recreation.
12. Public areas including roads, weekly market areas, Medical centres, Schools, Libraries, Car Parks etc. (the council can assess the property tax on these facilities on an individual basis)
All property/building will have the floor area recorded. (1-7) The other will have their physical areas measured.
The Local council will set tax rates for each PLL following guidance from the Regional Government. Any house not registered to a Family Tax Unit for more than 6 months will automatically be reassigned level 2, for taxation purposes.
The Local Council will also decide on change of use between above and enforce building regulations including also granting planning with energy/insulation targets etc. see above.
When planning is granted for Housing(1&2) Shops, Medical, Allotments, Schools and recreational space must also be provided within reasonable walking distance.
